1. Agreement to Terms

By accessing or using Gather & Gasp ("Service"), operated by Daly Planet Productions LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Gather & Gasp is a platform that generates custom murder mystery party kits. Our Service allows users to:

  • Create customized murder mystery party experiences
  • Download printable PDF materials including host guides, character booklets, and clue cards
  • Purchase individual mystery kits

3. User Accounts

To access certain features of our Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Purchases and Payments

4.1 Pricing

All prices are displayed in US dollars and are subject to change.

4.2 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your complete payment information on our servers.

4.3 Credits

Mystery generation is purchased using credits. Credits are available in the following options:

  • 3-Credit Pack: $14.99 ($4.99 per credit)
  • Single Credit: $6.99

Credits are consumed when generating a mystery. A standard mystery requires 1 credit and a premium mystery requires 2 credits. Credit prices are subject to change; any changes will apply only to future credit purchases, not to credits already on your account.

4.4 Credit Refunds

Purchased credits are non-refundable. Unused credits remain on your account indefinitely and do not expire. If a mystery generation fails due to a system error, the credits used for that generation will be returned to your account.

5. Refund Policy

We offer a 30-day satisfaction guarantee on all purchases. If you're not satisfied with your mystery kit, contact us at support@gatherandgasp.com for a full refund. See our full Refund Policy for details.

6. Intellectual Property

6.1 Our Content

The Service, including its original content, features, and functionality, is owned by Daly Planet Productions LLC and is protected by international copyright, trademark, and other intellectual property laws.

6.2 Your License

Upon purchase, you receive a non-exclusive, non-transferable license to use the mystery kit materials for personal, non-commercial purposes. You may:

  • Print materials for your own murder mystery party
  • Share printed materials with party guests
  • Host unlimited parties using your purchased kit

6.3 Restrictions

You may not:

  • Resell, redistribute, or commercially exploit the materials
  • Remove any copyright or proprietary notices
  • Use materials for commercial events without a corporate license
  • Create derivative works based on our content

7. AI-Generated Content

Our mystery kits are generated using artificial intelligence technology. While we strive for quality and consistency, you acknowledge that:

  • Content is generated algorithmically and may occasionally contain errors
  • Each mystery is unique and results may vary
  • We continuously improve our AI systems based on feedback

8. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Upload malicious code or content
  • Harass, abuse, or harm others

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DALY PLANET PRODUCTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Daly Planet Productions LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
